By commissioning a portrait you agree to the following

Terms & Conditions

Payment Due

Projects under $400 are paid in full at the time of checkout via the Artist’s Shopify store.

Projects totaling $400+ have a 50% nonrefundable deposit due prior to accepting the project, and the remaining amount due after approving the sketch.

In cases where a Payment Plan has been separately arranged and agreed upon in writing, the payment schedule outlined in that written agreement will govern.

Full payment is required before work begins unless a payment plan has been explicitly established in advance.

Refund Policy

The following refund terms apply to all commission orders:

Original Painting

All payments made toward the original painting are non-refundable. This applies regardless of the reason for cancellation, including if the Client becomes unresponsive or abandons the project. The Artist retains all funds received for the original painting as compensation for time, materials, and work completed.

Custom Add-On Items (Prints, Greeting Cards, etc.)

If the Client has purchased custom add-on items in addition to the original painting (such as prints or greeting cards), those items may be eligible for a refund under the following conditions:

  • The Client must request a refund for add-on items before the Artist has begun production of those items.
  • Refunds for add-on items are issued at the Artist’s discretion and are not guaranteed. However, the Artist will make a good-faith effort to honor such requests when made promptly.
  • If add-on items have already been produced or are in progress, they are non-refundable.
  • In the event of project abandonment (see below), all payments—including those for add-on items—are retained by the Artist by default. The Artist is not obligated to issue a refund for add-on items once a project has been deemed abandoned.

In all cases, no refund will exceed the amount paid for the specific item in question.

Cancellation

If the Client wishes to cancel a commission after work has begun, the following applies:

  • All funds paid toward the original painting are non-refundable.
  • If a payment plan was in effect, any outstanding balance for work completed may still be owed depending on the percentage of the project completed at the time of cancellation. The Artist will provide a written completion estimate at the time of cancellation.
  • Add-on items may be refunded if not yet in production (see Refund Policy above).

Client Responsiveness & Project Abandonment

The Artist will make every effort to maintain consistent communication throughout the project. The Client is expected to respond to Artist communications in a timely manner.

If the Client becomes unresponsive—defined as failing to reply to Artist communications for thirty (30) or more consecutive days—the Artist will make three (3) documented attempts to reach the Client across at least two (2) contact methods on file.

If the Client remains unreachable after these attempts, the project will be considered abandoned. Upon abandonment:

  • All payments made are non-refundable and retained by the Artist, including any amounts paid for add-on items.
  • The Artist is under no obligation to deliver, hold, or continue work on the commission.
  • If the Client later reestablishes contact, any resumption or re-creation of the piece will be treated as a new commission at the Artist’s current rates.

Revisions

The Artist will share progress images at key milestones for the Client’s review. The Client is entitled to three (3) rounds of revisions. Significant scope changes—such as adding subjects or altering the composition—may incur additional fees to be agreed upon in writing before work proceeds.

The Artist will communicate with the Client at minimum once per week while revisions are in progress.

Ownership & Rights

Upon receipt of final payment in full, the Client receives ownership of the original physical artwork and the right to display it for personal, non-commercial use.

The Artist retains the right to photograph and share images of the completed work in their portfolio, on social media, and for promotional purposes, unless the Client requests otherwise in writing prior to completion.

For watercolor portraits, the Artist retains the right to produce and sell prints and reproductions of the completed artwork. If you'd like to restrict this, a written request must be submitted prior to the project's completion, and exclusive reproduction rights may be negotiated separately in writing.

For canvas paintings, no prints or reproductions will ever be produced or sold. Your painting is, and will always remain, a one-of-a-kind original.
